On Tax Day, Representative Matt Hudson Offers Married Homeowners Relief

Tallahassee, FL – Legislation to eliminate an arcane feature in Florida Law which penalizes Floridians who marry homeowners passed a key house committee today and is headed for a full vote before the Florida House of Representatives.

The measure, House Bill 647 by Representative Matt Hudson (R-Naples) would put an end to the practice of assessing a new documentary stamp tax upon the addition of the name of a spouse to an existing deed.

“This bill ends unfair double taxation of homeowners who get married,” said Representative Hudson. “As the law stands, if a Floridian marries a homeowner and adds his or her name to the deed held by their spouse, they pay what is in essence a marriage tax. Yet the tax does not apply when a spouse is removed from a deed. The state is rewarding divorce and penalizing marriage.”

“This common sense measure won’t solve all our property tax problems, but it is good public policy and a small step in the right direction toward restoring fairness to our current property tax system,” added Rep. Hudson.

On a new home worth $300,000 and with a $240,000 mortgage, the tax savings would be $840.

HB 647 now heads to a vote before the full House.
